What we collect, why, and the choices you have.

Lucas Monaco Ventures LLC, doing business as InterviewMyCandidate ("IMC", "we", "us"), operates interviewmycandidate.com and the proctored video interview platform available there. This policy explains what personal information we handle, why, and what choices you have.

Read this part first. Your rights depend on which kind of user you are.

1. Two kinds of users

If you are a staffing agency, recruiter or employer (a "Customer"): we are your service provider and processor. We handle interview data on your instructions. You are the controller of candidate data.

If you are a job candidate: the company that invited you to interview — not IMC — decides what is collected, how it is evaluated, whether you are hired, and how long it is kept beyond our default schedule. We are the technology vendor they use. For most questions about your interview, and to exercise most of your rights, contact the company that invited you. If you contact us we will route your request and act directly where the law requires.

We act as a controller in our own right for website visitors, marketing contacts and account administrators — billing data, support tickets and site analytics.

What we do not collect from Candidates. We do not capture activity outside your browser tab. We do not read your files, your keystrokes outside the interview window, other applications, other monitors, or the contents of other browser tabs. Browser security prevents this and we do not attempt to work around it.

3. Identity photographs

Where the Customer enables identity verification, the Service captures two images at the start of your session: a photograph of the government-issued ID you present, and a selfie taken with your camera.

How they are used. A recruiter at the inviting company looks at the two images side by side to confirm the person taking the interview is the person named on the ID. That comparison is made by a human being.

We do not use facial recognition. The Service does not generate a facial template, faceprint, or scan of face or hand geometry, and does not run automated face matching against your images or any database. We do not use facial data to infer emotion, personality, character, honesty, demographic characteristics, health or employability. Because no scan of face geometry is created, these images are photographs rather than biometric identifiers under the Illinois Biometric Information Privacy Act (740 ILCS 14), which expressly excludes photographs.

Consent. You are told before your session that the interview is recorded and that identity images are captured, and you may decline. If you decline, the session does not proceed, and the inviting company decides whether to offer you an alternative interview format — contact them directly to ask.

Disclosure. We do not sell, lease, trade or otherwise profit from your identity images. They are disclosed only to the Customer who invited you, to the end client they submit you to where the Customer chooses to share them, and where required by law.

Retention and destruction. ID and selfie images are permanently deleted ninety (90) days after the session, or sooner on a valid deletion request. They are encrypted in transit and at rest.

If this changes. If we later introduce automated face matching or any technology that creates a scan of face geometry, we will update this policy, give notice, and obtain separate written consent before that processing begins.

4. Automated processing and its limits

The Service generates automated integrity signals and a Trust Score. These are probabilistic and imperfect. They produce false positives and false negatives, and can be affected by lighting, bandwidth, hardware, assistive technology, disability, neurodivergence and ordinary human behaviour such as looking away to think.

IMC does not make hiring decisions and does not recommend candidates. Our Terms require Customers to treat these outputs as information for human review only, and prohibit adverse action based solely on an automated output without a human reviewing the underlying recording.

If you believe an automated output affected a decision about you, contact the company that interviewed you. Depending on where you live you may have the right to an explanation, to human review and to contest the decision, including under GDPR Article 22, the Illinois Artificial Intelligence Video Interview Act, New York City Local Law 144 and the Colorado AI Act.

We do not sell personal information, share it for cross-context behavioural advertising, or use candidate recordings or images to train artificial intelligence or machine learning models.

6. How we disclose information

We do not disclose personal information to advertisers or data brokers.

Customers may set shorter retention and may delete records at any time. Once deleted we cannot recover them. We may retain data longer where required by law or a litigation hold.

8. Your rights

Candidates should start with the company that interviewed them. They control your interview data. If you do not know who to contact, or they do not respond, reach us through our contact page and we will identify them and forward your request.

Depending on where you live you may have the right to:

To submit a request, contact us with your name, the approximate date of your interview and the company that invited you. We verify identity, normally by confirming control of the email address used for the session, and respond within 45 days, extendable by a further 45, or within one month under the GDPR.

Residents of the EEA and UK may lodge a complaint with a supervisory authority. California residents: the categories of personal information we collect include identifiers, audio and visual information, internet activity and geolocation; sections 2, 5, 6 and 7 describe the purposes and recipients.

9. Security

We use encryption in transit and at rest, access controls and least-privilege permissions, audit logging, and regular infrastructure updates. Submission links use unguessable tokens and can be revoked by the Customer.

No system is perfectly secure. Share links are unauthenticated by design — anyone holding a link can view the submission until it is revoked. If we become aware of a breach affecting your personal information we will notify affected Customers without undue delay, and Candidates where required by law.

10. Cookies

We use strictly necessary cookies for authentication, session continuity and security; these cannot be disabled without breaking the Service. Where required we request consent before setting analytics or preference cookies. We do not use advertising or cross-site tracking cookies.

11. International transfers

We are based in the United States and process data on servers in the United States. If you use the Service from elsewhere your information is transferred to and processed in the US, where data protection laws differ. Where required we rely on the European Commission Standard Contractual Clauses and the UK Addendum, with encryption as a supplementary measure.

12. Children

The Service is intended for adults in an employment context. We do not knowingly collect personal information from anyone under 16. If you believe a minor has provided information, contact us and we will delete it.

13. Changes

We may update this policy. We post the new version with a revised date and, for material changes affecting Candidates or identity verification, give notice before the change takes effect. Material changes to how identity images are handled require renewed notice, and renewed consent where the law requires it.
